Overview
Welcome to Poppy&Scout. “We”, “us” and “our” refer to Poppy&Scout. We run this website and online store, which is powered by Shopify. These terms, together with our Shipping Policy, Refund Policy and Privacy Policy (the “Terms”), apply when you use our website or buy from us. By using our website or placing an order, you agree to these Terms.

1. Your consumer rights
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Consumer Guarantees Act 1993 (NZ), the Fair Trading Act 1986 (NZ), the Australian Consumer Law or any other law that cannot lawfully be excluded. All other terms apply only to the extent the law allows.

2. Using our website
You must be 18 or over, or have a parent or guardian’s permission, to buy from us. The information you give us when ordering must be accurate and up to date. If you create an account, keep your login details secure. You’re responsible for activity on your account.

3. Our products
We take care to show our products accurately. However, colours may look slightly different depending on your screen. We may update product descriptions, discontinue products, or limit order quantities at any time.

4. Orders
When you place an order, you’re making an offer to buy. Your order is accepted when we confirm it by email. We may decline an order before we accept it. If we can’t fulfil an order after accepting it, we’ll let you know and refund you in full. Returns are covered by our Refund Policy. Our products are sold for personal or household use, not for resale.

5. Prices and payment
Prices are shown in New Zealand dollars for New Zealand orders and Australian dollars for Australian orders. Prices include any applicable GST. Shipping is calculated at checkout. The price you pay is the price shown when you place your order. If a price is clearly wrong because of an error, we may cancel the order and refund you in full. Promotions may have their own terms. You must be authorised to use the payment method you provide.

6. Shipping and delivery
Shipping is covered by our Shipping Policy. Delivery times are estimates only. Ownership of and risk in the products pass to you on delivery.

7. Intellectual property
The content on our website, including our name, logo, text and images, is owned by us or our licensors. It is protected by copyright, trade mark and other intellectual property laws. You may use our website for personal, non-commercial purposes only. You must not copy or reuse our content without our written permission.

8. Third-party tools and links
Our website may include tools provided by third parties or links to other websites. We don’t control them and aren’t responsible for their content, availability or practices. Your use of them is subject to their own terms.

9. Shopify
Our store is powered by Shopify. When you buy from us, your contract is with Poppy&Scout, not Shopify.

10. Privacy
Our Privacy Policy explains how we collect, use and protect your personal information.

11. Reviews and feedback
If you send us feedback or post a review, you allow us to use, reproduce and publish it free of charge. Your feedback must be honest. It must not be unlawful, offensive or misleading, and it must not infringe anyone else’s rights. We may remove content that breaches these Terms.

12. Errors
Our website may occasionally contain errors, for example in product descriptions, prices, shipping charges or availability. We may correct errors at any time. If an error affects an order you’ve placed, we’ll contact you and you can choose to cancel for a full refund.

13. Prohibited uses
You must not use our website for any unlawful purpose. You must not interfere with its security or operation. You must not scrape or copy it, or use it to harass anyone or send spam.

14. Suspension
We may suspend or close your access to our website or account if you breach these Terms.

15. Website disclaimer
Subject to section 1 and to the extent the law allows, our website is provided “as is”. We don’t guarantee it will always be available or error-free.

16. Limitation of liability
Subject to section 1 and to the extent the law allows, we’re not liable for any indirect or consequential loss, or for loss of profits, revenue or data, arising from your use of our website.

17. General
If any part of these Terms is found to be unenforceable, the rest still applies. If we don’t enforce a right straight away, that doesn’t mean we’ve given it up. You may not transfer your rights under these Terms without our consent.

18. Governing law
These Terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction. If you’re a consumer in Australia, this doesn’t affect your rights under the Australian Consumer Law.

19. Changes to these Terms
We may update these Terms from time to time by posting the new version on this page. Changes apply to orders placed after the update.
